Un mineur condamné à mort
Dans la préfecture de Miyagi, un jeune homme de 19 ans a été jugé pour double meurtre. C’est la première fois qu’un mineur est condamné à la peine de mort depuis la mise en place de jurys populaires l’année dernière. Dans cette affaire, le meurtrier est accusé d’avoir poignardé à mort la sœur de son ancienne petite amie, Mika Nambu, son amie Mikako Omori et blessé grièvement un homme pendant l’agression en février quand il n’avait encore que 18 ans.
Il est également accusé d’avoir enlevé son ancienne petite amie et de l’avoir blessée à la jambe gauche.
Le juge Suzuki a dit que même s’il avait que 18 ans au moment des faits, ce n’était pas une raison valable de lui épargner la peine capitale. Il a ajouté qu’il y avait très peu de chances pour qu’il soit réinséré.
La peine de mort peut être appliquée à un mineur après avoir pris en comptes certains critères comme la brutalité et la raison du crime, le nombre de victimes, l’âge et le casier judicaire de l’accusé…
Le point le plus important du procès était de savoir si l’accusé devait être condamné à mort car il a plaidé coupable (sauf pour l’enlèvement).
Minor sentenced to death
In Miyagi Prefecture, jurors sentenced a 19 year-old-man for a double murder. It’s the first death penalty given to a minor under the new lay-judge trial system that began last year.
In this case, the murderer is accused of stabbing his ex-girlfriend’s older sister, Mika Nambu, her friend, Mikako Omori, and seriously injuring a man in the attack in February when he was 18.
The defendant is also accused of kidnapping his former 18-year old girlfriend and injuring her in the left leg.
Judge Suzuki said that the defendant was 18 at the time of the crime but it isn’t a reason for the court to avoid the death penalty. He also said that the possibility of his rehabilitation is extremely low.
The capital punishment can be imposed on a minor after taking into consideration factors like the brutality and the reason of the crime, the number of victims, the age and criminal records of the defendant.
The focal point of the trial was whether the capital punishment should be given because the minor pleaded guilty except for the kidnapping.
